NOTICE OF THE MAKING OF A COMPULSORY PURCHASE ORDER UNDER AND FOR THE PURPOSES OF SECTION 76 OF AND THE THIRD SCHEDULE TO THE HOUSING ACT, 1966 (AS AMENDED),  AS EXTENDED BY SECTION 10 OF THE LOCAL GOVERNMENT (NO. 2) ACT, 1960, SUBSTITUTED BY SECTION 86 OF THE HOUSING ACT, 1966 (AS AMENDED),  AND AS AMENDED AND EXTENDED BY THE PLANNING AND DEVELOPMENT ACT 2000 (AS AMENDED) ,LOCAL GOVERNMENT ACT 1925 (AS AMENDED), ROADS ACT 1993 (AS AMENDED) AND ALL OTHER ACTS THEREBY ENABLING THE COMPULSORY PURCHASE OF LANDS PUBLISHED IN ACCORDANCE WITH ARTICLE 4(A) OF THE THIRD SCHEDULE TO THE HOUSING ACT, 1966 AS AMENDED.

 COMPULSORY PURCHASE ORDER 2021

The Louth County Council (hereinafter referred to as "the local authority") in exercise of the powers conferred upon them by THE ABOVE NAMED ACTS have made an order entitled as above which is about to be submitted to An Bord Pleanála (hereinafter referred to as “the Board”) for confirmation.

If confirmed, the order will authorise the local authority to acquire compulsorily, including the substrata thereof, the land described in Part I.a of the Schedule thereto, and to acquire temporarily, the land described in Part I.b of the Schedule thereto, for the purposes of the construction of the Carlingford Lough Greenway, Omeath to the Border and all ancillary works associated therewith.

Owners, lessees and occupiers of the land described in the Schedules will receive individual written notice.

Any objection to the Compulsory Purchase Order must state in writing, the grounds of objection and be sent to An Bord Pleanála, 64 Marlborough Street, Rotunda, Dublin, D01 VP02 so as to reach the Board by the 7th October 2021.

If an objection is made in respect of the said acquisition by an owner, lessee or occupier of the lands and is not withdrawn, the Board may at its absolute discretion hold an oral hearing in relation to the matter. Before making its decision on an application to confirm the Compulsory Purchase Order, An Bord Pleanála must consider any objection made and not withdrawn, any additional submissions or observations made pursuant to Section 217A of the Planning and Development Acts 2000 to 2019 and any report of the person who held the oral hearing, if such an oral hearing takes place.

A copy of the Order and of the map referred to in it may be seen at the offices of Louth County Council, Town Hall, Crowe Street, Dundalk, Co. Louth between the hours of 9.30am and 5.00pm on working days between the 14th September 2021 and the  7th October  2021  and on our website at www.louthcoco.ie.
